At Vreeken's Zaden, we love everything that grows and blooms. We believe it is just as important to handle your personal data with care.

Whether you order seeds through our online shop, visit our store in Dordrecht or subscribe to our newsletter, we handle your data carefully.

In this privacy policy, we explain which personal data we process, why we use it, with whom we share it and what rights you have.

1. Who are we?

Vreeken's Zaden specialises in the sale of seeds, plants, flower bulbs, planting material and other gardening products. We sell through our online shop and our physical store in Dordrecht, and supply customers within the European Economic Area.

Vreeken's Zaden B.V. is responsible for the processing of personal data.

2. What personal data do we process?

The personal data we process depends on how you use our services.

We may process the following data:

· Contact details: name, address, city or town, country, email address and telephone number.

· Order details: products ordered, order history, order numbers, deliveries and returns.

· Payment details: payment method, payment status, transaction details and invoice information.

· Account details: information associated with your customer account and order history.

· Communication details: messages and information you share with us when you contact us.

· Website data: IP address, browser information, device information and information about your use of our online shop.

· Marketing data: newsletter preferences, purchasing interests and data used for customer segmentation.

· CCTV footage: images of visitors and employees in our physical store.

We do not collect dates of birth as part of our regular customer registration process.

We need certain information to fulfil an order. You provide other information voluntarily, or we process it where there is a valid legal basis for doing so.

3. Why do we process personal data?

We use personal data for various purposes, including:

Orders and payments

We process your data to accept orders, process payments, deliver products and handle any returns or complaints.

Customer accounts

When you use a customer account, we process the information needed to make your account and order history available to you.

When you contact us, we use your data to answer questions, resolve problems and help you with our products or services.

Administration

We process financial data and invoice information to maintain our records and comply with tax obligations.

Security

We may process personal data to investigate or combat fraud, misuse and security incidents.

Legal basis: our legitimate interest in protecting our business and customers, provided that the processing is necessary and proportionate.

Marketing

We use personal data for newsletters and other marketing activities where valid consent has been given or where a statutory exception for existing customers applies.

4. Payments

When you place an order with us, you can use various payment methods, including:

· PayPal

· Credit card

· Apple Pay

· Google Pay

· Payment by invoice, where offered

Depending on the payment method you choose, the necessary data will be processed by the payment provider involved.

These providers may act as independent controllers for certain processing activities, such as payment authorisation, fraud prevention and legal checks.

For payments by invoice, we process the necessary invoice and payment information in our records.

5. Shipping and delivery

We use Sendcloud and carriers such as PostNL and DHL to ship orders.

To deliver your order, we share the necessary personal data with the shipping partners involved.

This may include your name, delivery address, email address, telephone number and shipment details.

We ship our products within the European Economic Area.

6. Newsletters and marketing

We like to keep gardening enthusiasts informed about new products, unusual seeds, special offers, growing tips and seasonal news.

We use Omnisend for our newsletters and email marketing.

Newsletter subscriptions

You can subscribe to our newsletter through our website or during checkout.

We send marketing emails when you have given valid consent or when the statutory exception for existing customers applies.

Among other conditions, this exception requires the messages to concern our own similar products or services, and you must be able to object easily both when we collect your email address and in every marketing email.

Automated emails

We also use automated emails, including:

· Welcome messages after subscribing.

· Abandoned cart reminders.

· Other marketing messages relevant to your customer relationship or interests.

The same statutory rules on consent and existing customers apply to these marketing messages.

Customer segmentation

We use Omnisend to create customer groups based on available customer data, such as order history, purchasing interests and interactions with marketing messages.

This enables us to tailor our communications more closely to customers' interests.

We also send our general newsletter to a broad group of eligible newsletter recipients.

Where consent is required to collect or use certain interaction data, we process that data only if consent has been obtained.

Unsubscribing

You can unsubscribe from marketing emails at any time using the unsubscribe link at the bottom of our emails.

You can also contact us at info@vreeken.nl to unsubscribe.

After you unsubscribe, we will no longer use your email address for the marketing messages concerned. We may retain a limited record of your unsubscribe request to honour your choice.

You may still receive order confirmations and other necessary service messages.

7. Cookies and website analytics

Our online shop uses cookies and similar technologies.

A cookie is a small file that stores or reads certain information when you visit a website.

We use different categories of cookies.

Functional cookies

These are necessary for the online shop to function, for example to remember your shopping cart, enable your account to work and allow orders to be placed.

Prior consent is not required for strictly necessary cookies.

Analytics cookies

We use Google Analytics 4 to analyse how our website is used.

This provides insight into, for example, which pages are visited, how the online shop is used and the performance of various parts of the website.

Marketing cookies

We use Google Ads and Meta Pixel, among other tools, to measure advertising performance and, where permitted, to deliver personalised advertising.

We also use Google Tag Manager to manage tracking and analytics tags.

We ask for consent in advance for cookies and similar technologies that require it.

CookieYes and your preferences

We use CookieYes to manage cookie preferences.

You can use the cookie banner to accept or reject non-essential cookies, or set your preferences individually.

You can change these preferences later through the cookie settings on our website.

8. Customer ratings and reviews

Our customers' experiences matter to us.

We therefore use external review platforms, including Trustpilot and Google Reviews.

After an order, we may automatically send an invitation to review our service.

To send such invitations, information such as your name, email address and order reference may be processed or shared with the review service concerned, insofar as this is necessary and lawful.

When you post a review, the platform concerned may process personal data independently. Please also consult that platform's privacy policy.

We use customer reviews to gain insight into customers' experiences and improve our services.

9. CCTV surveillance in our store

We use CCTV surveillance in our store in Dordrecht to protect visitors, employees, products and business property.

Signs are displayed at the store to inform visitors that CCTV surveillance is in operation.

CCTV footage is retained for a maximum of 28 days and then deleted, unless the footage is needed to deal with an incident, such as theft or damage.

In that case, relevant footage may be retained for longer, for as long as necessary to deal with the incident.

CCTV footage may only be viewed by the management and owners of Vreeken's Zaden.

Where necessary and legally permitted, relevant footage may be provided to the competent authorities.

Legal basis: our legitimate interest in protecting people and property, provided that the requirements for CCTV surveillance are met.

10. With whom do we share personal data?

We use specialist service providers to operate our business.

We share personal data only where a valid legal basis exists and only to the extent necessary.

The service providers involved may have different roles under data protection law. Some process data on our behalf; others act as independent controllers for certain processing activities.

Where legally required, we enter into data processing agreements with our service providers.

We may also disclose personal data where we are legally required to do so.

11. Shopify

Our online shop runs on the Shopify e-commerce platform.

Shopify processes personal data needed to operate our online shop, manage customer accounts and process orders.

Depending on the services used, Shopify may act as an independent controller for certain data processing activities.

Vreeken's Zaden does not use Shopify Audiences or Shopify Network Intelligence.

12. Retention periods

We do not retain personal data for longer than is necessary for the purpose for which it is processed, unless a legal obligation or another valid reason makes longer retention necessary.

Orders and financial records

A statutory retention period of seven years applies to our basic tax records.

Because we use the European One Stop Shop (OSS) scheme, we retain records of transactions covered by that scheme for the applicable statutory period of ten years.

Customer accounts

Customer accounts and associated data are retained for as long as the account exists, unless the data must be deleted sooner.

You may request deletion of your account or personal data.

Data that we are required to retain due to legal obligations or other valid reasons cannot always be deleted immediately.

Customer service and correspondence

We retain emails and other correspondence with our customers for a maximum of seven years.

Where longer retention is necessary, for example in connection with a dispute, an ongoing contract or a legal obligation, relevant data may be retained for longer.

Newsletter data

We process newsletter data for as long as you remain subscribed or as long as another valid legal basis exists for sending marketing messages.

After you unsubscribe, we retain a limited record where necessary to honour your choice.

CCTV footage

We retain CCTV footage for a maximum of 28 days, unless relevant footage is needed for longer to deal with an incident.

Cookie retention periods vary by cookie and are listed in the cookie overview on our website.

13. How do we protect personal data?

We believe it is important to process personal data carefully and securely.

We therefore implement appropriate technical and organisational security measures that reflect the nature of the data and the risks of the processing.

We also take personal data protection into account when selecting and using external service providers.

14. Processing of data outside the EEA

Vreeken's Zaden delivers products exclusively within the European Economic Area (EEA).

This does not automatically mean that all personal data is processed exclusively within the EEA.

Some international technology companies we work with may process personal data outside the EEA or have access to data from another country.

Additional data protection rules apply to such transfers.

Transfers outside the EEA are permitted only where the legal conditions are met, for example on the basis of an adequacy decision or appropriate contractual safeguards.

15. Your data protection rights

Under the General Data Protection Regulation (GDPR), you have various rights.

Among other things, you may ask us to:

· Access: show you which personal data we process about you.

· Rectification: correct inaccurate data.

· Erasure: delete personal data where you have the right to request this.

· Restriction: restrict the processing of certain personal data.

· Data portability: provide certain data in a commonly used, machine-readable format or transfer it to another party.

· Objection: object to certain processing activities, including processing for direct marketing.

· Withdrawal of consent: withdraw consent you have previously given.

Not all of these rights apply in every situation. For example, we may be required to retain certain information to comply with tax obligations.

We generally respond within one month. Where a request is complex, this period may be extended under the conditions set out in the GDPR.

If necessary, we may ask for additional information to verify your identity.

17. Children

Our online shop and store are intended for a general audience, including families and gardening enthusiasts.

Our services are not specifically directed at collecting personal data from children under the age of 16.

Where consent is required for a particular processing activity involving a child's personal data, we take the applicable legal requirements into account.

We may amend this privacy policy if our services, the systems we use or our legal obligations change.

The most recent version is available on our website. We will inform those concerned of significant changes where legally required.
